{"id":812,"date":"2018-05-13T14:00:50","date_gmt":"2018-05-13T12:00:50","guid":{"rendered":"https:\/\/britishdailynews.co.uk\/?p=812"},"modified":"2018-05-11T14:14:40","modified_gmt":"2018-05-11T12:14:40","slug":"facebook-hit-with-class-action-lawsuit-over-collection-of-texts-and-call-logs","status":"publish","type":"post","link":"https:\/\/britishdailynews.co.uk\/?p=812","title":{"rendered":"Facebook hit with class action lawsuit over collection of texts and call logs"},"content":{"rendered":"<p>Facebook is facing a class action lawsuit over the\u00a0revelations that it logged text messages and phone calls\u00a0via its smartphone apps.<\/p>\n<p>In\u00a0the lawsuit\u00a0filed in Facebook\u2019s home of the northern district of California, the primary plaintiff, John Condelles III, states that the social network\u2019s actions \u201cpresents several wrongs, including a consumer bait-and-switch, an invasion of privacy, wrongful monitoring of minors and potential attacks on privileged communications\u201d such as those between doctor and patient.<\/p>\n<p>Facebook\u00a0collected the logs of text messages and calls, including the recipients and duration of the communications, through its apps for Android including Messenger when users opted into being able to send SMS from the app or give access to their contact lists.<\/p>\n<p>\u201cFacebook has collected and stored information in a scope and manner beyond that which users knowingly authorised. The practice is ongoing,\u201d states the filing first\u00a0reported by the Register.<\/p>\n<div id=\"dfp-ad--inline1\" class=\"js-ad-slot ad-slot ad-slot--inline ad-slot--inline1 ad-slot--rendered\" data-link-name=\"ad slot inline1\" data-name=\"inline1\" aria-hidden=\"true\" data-mobile=\"1,1|2,2|300,250|300,274|fluid\" data-desktop=\"1,1|2,2|300,250|620,1|620,350|300,274|fluid\" data-google-query-id=\"CPrr8oDR_doCFcGSdwodL-QMEg\">\n<div id=\"google_ads_iframe_\/59666047\/theguardian.com\/technology\/article\/ng_0__container__\" class=\"ad-slot__content\">The extent of the collection was revealed when users began downloading and sifting through the data Facebook held on them following the\u00a0Cambridge Analytica scandal.<\/div>\n<\/div>\n<p>The plaintiffs allege that Facebook\u2019s collection of the data from users\u2019 phones breaches California\u2019s Unfair Competition Law on three counts \u2013 including fraudulent business practice \u2013 in addition to the Consumer Legal Remedies Act and the Electronic Communications Privacy Act.<\/p>\n<p>The filing states: \u201cThe terms of service and privacy notice materials do not inform (and in the past have not informed) the ordinary and reasonably attentive Facebook user that installing the application on a mobile device will result in the logging of all the user\u2019s phone and text communications \u2014 including recipients, dates of communication, length of communication and mode of communication \u2014 on Facebook\u2019s servers for Facebook\u2019s own use.\u201d<\/p>\n<aside class=\"element element-rich-link element-rich-link--tag element--thumbnail element-rich-link--upgraded\" data-component=\"rich-link-tag\" data-link-name=\"rich-link-tag\">\n<div class=\"rich-link tone-feature--item rich-link--pillar-news\">\n<div class=\"rich-link__container\">\n<div class=\"rich-link__read-more\">\n<div class=\"rich-link__read-more-text\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/aside>\n<p>Until 2012, any\u00a0Android\u00a0application that could access contacts could also access phone and text logs, but the operating system did not explicitly notify users of that fact.<\/p>\n<p>\u201cBy granting this access, Android users were also automatically and unknowingly granting Facebook permission to \u2018scrape\u2019, or automatically gather, Android users\u2019 call and text logs,\u201d states the lawsuit. \u201cIn other words, Facebook scraped years\u2019 worth of call and text data, including whether the call was \u2018incoming\u2019 \u2018outgoing\u2019, or \u2018missed;\u2019 the data and time of each call; the number dialled; the individual called; and the duration of each call.\u201d<\/p>\n<p>Condelles is seeking at least $5m and to turn the suit into a class action across the US.<\/p>\n<p>Facebook is also facing a class action lawsuit from both British and US lawyers as\u00a0part of a case\u00a0against the social network, Cambridge Analytica and two other companies for allegedly misusing the personal data of 71 million people.<\/p>\n<p>Facebook did not immediately respond to request for comment.<\/p>\n<p>source:https:\/\/www.theguardian.com\/technology\/2018\/may\/11\/facebook-class-action-lawsuit-collection-texts-call-logs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Facebook is facing a class action lawsuit over the\u00a0revelations that it logged text messages and phone calls\u00a0via its smartphone apps.
