In this dynamic scenario, legal firms that aim to remain competitive must adapt to modern challenges without abandoning the values and solidity that define long-standing legal traditions. Attorney Monetti, Monetti & Associates is known for its century-long family tradition. What are the firm’s core areas of practice, and how is it addressing the challenges of today’s legal market?
By blending tradition with innovation, our firm has evolved from a historic family-run practice into a well-structured organizational model. A group of professionals, united by shared goals and values, has taken on the challenges of a rapidly changing legal market with the ambition to continually improve our services and expand our geographic reach across the entire national territory. Our main areas of expertise include banking law, debt relief, business crisis management, and judicial auctions. In the coming years, the firm intends to further diversify its services, also through mergers and acquisitions, aiming to better meet the varied legal needs of the market.
One of the firm’s core specialties is banking litigation. Can you explain what this entails?
Banking litigation broadly refers to all judicial and extrajudicial procedures initiated to resolve disputes between banks and their clients. It is undoubtedly one of the most complex and technical areas of law, encompassing a wide range of issues. A client, for example, may choose to initiate litigation to recover funds unlawfully charged by the bank due to unauthorized interest rates, illegal overdraft fees, compound interest, abusive loan terms, or to remove harmful records mistakenly listed in credit databases. Conversely, litigation may also be initiated by the bank through actions such as injunctions or foreclosure proceedings. As you can see, this is an extremely technical field, characterized by highly variable case law at both the trial and appellate levels.
Your firm also specializes in debt relief and business crisis procedures. What are these exactly?
In today’s economic climate, tools for managing debt and business crises represent an essential lifeline. For struggling businesses, crisis resolution procedures offer structured pathways that allow not only for recovery from critical situations but also for rebuilding the business on a more stable foundation. Likewise, for over-indebted consumers, these mechanisms offer a tangible opportunity to regain financial balance and avoid social and economic marginalization.
There is increasing talk of artificial intelligence in every sector. How is it influencing legal practice?
We can say that artificial intelligence has not yet had a major impact on the legal sector, but it is undoubtedly an emerging force that is set to revolutionize our everyday lives.
Do you believe AI is destined to fully replace some legal functions — and perhaps even lawyers — or will it remain a complementary tool?
I don’t rule out that AI may eventually replace many legal functions. Lawyers who want to remain competitive in an increasingly tech-driven market must learn to integrate new technologies into their work. AI will therefore become a vital support tool in managing legal processes, allowing attorneys to focus on the more complex and strategic aspects of their cases.
Your firm also assists those interested in purchasing properties through judicial auctions. Despite the complexity of the regulations and procedures involved, do you think this is a worthwhile investment?
That’s a great question. Judicial auctions represent an attractive opportunity to purchase real estate at potentially below-market prices. However, they are also a complex and often risky process that demands a deep understanding of legal procedures and potential complications. These types of transactions are not without risk, as they involve legal and procedural complexities that must be handled with great care. That’s why it’s essential to rely on professionals with expertise in this field. Within our firm, we have built a team of experts capable of guiding clients through any challenges related to the purchase of property at judicial auctions. Our goal is to minimize the legal and financial risks associated with such purchases, making this option a safe and profitable investment for our clients.
